Both the counsel submit that suit being O.S.No.559 of 2004 on the file of the Court of Junior Civil Judge, Bhimavaram, out of which this civil revision petition arose, was dismissed for default on 12.8.2009. Therefore nothing survives in this civil revision for the present. If so advised petitioner may move an application under Order IX Rule 9 of Code of Civil Procedure, 1908, to set aside order dismissing the suit for default.
