THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.42888 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of mandamus declaring the action of the respondents in not taking any action against the sixth respondent for making illegal construction of an RCC roof building without any permission from the fifth respondent-Gram Panchayat, by encroaching into the petitioner's land, as illegal and arbitrary.

At the time of hearing, learned counsel for the fifth respondent submitted that the sixth respondent submitted a plan for construction of the house to the fifth respondent, which in turn passed a resolution on 24.9.2016. In pursuance of the resolution, the Secretary, Gram Panchayat, P.Polavaram issued the orders on 25.9.2016 permitting the sixth respondent to make construction. In view of the submission made by the learned counsel for the fifth respondent, no further orders are necessary in this writ petition. 3.
