HON'BLE Smt JUSTICE ANIS CRIMINAL PETITION No.14142 of 2016 ORDER:

This Criminal Petition is filed by the petitioner, under Section 482 Cr.P.C, seeking quashment of proceedings in C.C.No.313 of 2015 (old C.C.No.224 of 2013) on the file of Additional Judicial Magistrate of First Class at Tiruvur, Krishna District.

The allegations are that the petitioner, along with others, stating to be supporters of YSR party, gathered at Tiruvur RTC bus stand and obstructed running of RTC buses and the passerby. On the complaint of the head constable, Crime No.119 of 2012 was registered for the offences punishable under Sections 341, 143 and 188 IPC. After completion of investigation, police filed charge sheet. Learned counsel for the petitioner submits that, since the petitioner - A2 was not present before the Court below on 11.01.2016, non-bailable warrant was issued against him and the same is pending.

The petitioner, however, did not file any application for recall of non-bailable warrant. Instead, he filed this Criminal Petition seeking to quash C.C.No.313 of 2015. Considering the facts and circumstances of the case, the petitioner is directed to file an application before the Court below seeking to recall non-bailable warrant and, on

filing of such application, learned Magistrate shall consider and pass necessary orders.

With the above observation, the Criminal Petition is closed. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
