HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.16637 OF 2008 ORDER:

This writ petition is filed by the petitioner challenging the action of the 1st respondent in granting permission to the 2nd respondent for construction of a building in the subject land, and seeking to cancel the said permission.

The 1st respondent filed a counter stating that after obtaining the building permission, the 2nd respondent has already completed the constructions and therefore, the cancellation of permission does not arise. 3.

Considering the averments in the counter, this Court is of the view that nothing survives for adjudication in this writ petition. If the petitioner is aggrieved over any of the constructions made by the 2nd respondent, he is at liberty to seek his remedy before the appropriate forum. 4.
