THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13910 of 2025 This Criminal Petition is filed seeking the Court to enlarge the petitioners on bail, who are arrayed as accused Nos.1 and 2 in FIR No.270 of 2025 of Yacharam Police Station, Rachakonda Commissionerate.

The brief facts of the case are that on 03.10.2025, the police on credible information had conducted a raid and seized 8 kgs of Ganja from the possession of accused Nos.1 and 2. The accused Nos.1 and 2 were arrested and a case was registered against them for the offences punishable under Sections 20(a), 20(b)(ii)(B) and 29 of the NDPS Act, 1985.

Heard Sri P. Manoj, learned counsel appearing on behalf of the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioners submitted that the petitioners are in jail from 04.10.2025 and the seized

quantity of the ganja is an intermediate quantity and the bail petition of the petitioners was dismissed by the trial Court vide order dated 24.10.2025 in Crl.M.P.No.2197 of 2025. It is further submitted that the investigation was already completed. Therefore, he prayed the Court to grant bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the petitioners are serious in nature. It is further submitted that there are no previous cases pending against the petitioners herein. Therefore, he prayed the Court to dismiss the criminal petition. 6.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners herein are in jail from 04.10.2025 and the seized quantity of the ganja 8 kgs, which is an intermediate quantity and there are no other cases pending against the petitioners.

Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioners, subject to the following conditions.

i.

The petitioners shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge, at L.B. Nagar, Rangareddy District.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
