THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TR.CMP.No.624 OF 2016 ORDER:

This petition is filed under Section 24 of C.P.C seeking to withdraw H.M.O.P.No.71 of 2016 pending on the file of the Court of the Senior Civil Judge, Bhimavaram, West Godavari District and transfer the same to the Family Court, Vijayawada. At the time of arguments, both counsel submitted that H.M.O.P.No.71 of 2016 pending on the file of the Court of the Senior Civil Judge, Bhimavaram may be transferred to the Family Court, Eluru. The learned counsel for the petitioner submitted that the respondent may be directed to pay transportation charges to the petitioner whenever the petitioner present before the Family Court, Eluru. In view of the submissions made by the learned counsel for both the parties, this court is not inclined to go into the merits of the main case.

In the result, the petition is allowed, H.M.O.P.No.71 of 2016 pending on the file of the Court of the Senior Civil Judge, Bhimavaram, West Godavari District is withdrawn from the file of the said court and transferred to the Family Court, Eluru for disposal in accordance with law. The respondent is directed to pay an amount of Rs.600/- to the petitioner as and when the petitioner attends the Family Court, Eluru. As a sequel, miscellaneous petitions, if any pending in this petition shall stand closed.
