THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.13913 of 2025 ORDER:
The present Criminal Petition is filed praying this Court to enlarge the petitioner on bail, who is arrayed as accused No.2 in Crime No.420 of 2022 in SC.No.331 of 2023 before the Pet Basheerabad Police Station, Medchal Malkajgiri District, and on the file of the II Additional District and Sessions Judge, Medchal Malkajgiri District, at Medchal, registered for the offences punishable under Sections 302, 379, 201 read with 34 of IPC. 2.
The brief facts of the case are that the complainant, reported that her 73-year-old mother, was found dead in her house on June 27, 2022, after being unresponsive for three days. The mother's body was in a decomposed state, with no visible injuries, but the room was covered in fluids and blood, and cupboards were open, leading the complainant to suspect foul play and request police action against the culprits who allegedly killed her mother. On receipt of the said complaint, a case was registered for the offences as alleged.

Heard Sri P.Manoj, learned counsel for petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for respondent - State.

Learned counsel for petitioner submitted that the allegations against the petitioner are false, baseless, and lack evidence, and the petitioner is innocent, law-abiding, and not involved in any other criminal cases. He asserted that the petitioner has been in judicial custody since 24.05.2025 and averred that this Court has already granted regular bail to accused No.1/prime accused vide order dated 24.09.2025 passed in Crl.P.No.11870 of 2025. Therefore, prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for petitioner stating that the allegations leveled against the petitioner are of serious nature. Therefore, prayed the Court to dismiss the criminal petition.

Having regard to rival submissions made and on going through the material placed on record, it is noted that the petitioner is in judicial custody since 24.09.2025 and it is seen
that the prime accused is granted regular bail. Considering the period of incarceration of petitioner, this Court deems it fit to grant bail to the petitioner, subject to following the below conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of the IX Judicial Magistrate of First Class, at Medchal.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 480(3) of the BNSS, earlier known as Section 437(3) of Cr.P.C.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
