The petitioner prays for the following relief :- " ......... declaring the inaction of the 2nd respondent Tahsildar in verifying whether or not pattas have been granted in Survey No.42-B2 and consequently not taking any remedial action for the alleged reason that Survey No.42 finds a mention in the orders of this Hon'ble Court dated 31-10-2012 in W.P.No.33914/ 2012 as illegal ........."
According to petitioner, suit in O.S.No.302 of 2006 in the Court of Senior Civil Judge, Kadapa, is pending in respect of the subject matter claimed by the petitioner through sale deed said to have been executed in the year 2005.
Mr.Srinath fairly submits that as the suit is pending on the date of filing of the writ petition, the party has to work out remedies in the pending suit and seeks liberty of the Court to pursue civil litigation, if so advised.
After going through the material papers, I am of the view that this Court has difficulty in considering and directing the 2nd respondent to look into this omnibus prayer and take a decision. The prayer is misconceived.
The writ petition fails and is accordingly dismissed. No order as to costs.
