THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.10749 OF 2017 ORDER:

Petitioner is a Conductor. On 02.03.2017, he was served with the suspension order as well as charge sheet. The petitioner challenges the order of suspension and the charge sheet in this Writ Petition. The sum and substance of the allegations in the charge sheet is that firstly the petitioner was in a drunken condition while he was on duty causing inconvenience to the travelling public and also caused damage to the reputation of the institution and secondly the petitioner absconded from duty from Kothagudem Bus Station without intimation to the higher officials. 2.

The allegations made in the charge sheet if proved are grave and therefore, a regular enquiry has to be conducted. This Court is not inclined to express any opinion on the nature of charges, at this stage. It is not the case of the petitioner that the Depot Manager is not competent to place him under suspension. 3.

Learned counsel for the petitioner submits that if a direction is issued to the respondent - Corporation to complete the enquiry as expeditiously as possible, it would meet the ends of justice. 4.

Learned Standing Counsel for the respondent - Corporation submits that if the petitioner cooperates with the enquiry to be conducted, the same shall be completed within a reasonable time. 5.

Having regard to the said submissions, the Writ Petition is disposed of directing the respondent - Corporation to complete the disciplinary action, as expeditiously as possible, preferably within

a period of two months from the date of receipt of a copy of this order. It is needless to observe that the petitioner shall cooperate in completing the enquiry and if he does not cooperate for the same, it is open to the respondent - Corporation to take further course of action, as warranted by law. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
