THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37294 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the respondent police in registering of FIR No.230 of 2016, as illegal and arbitrary.

Heard and perused the material available on record. The main grievance of the petitioner is that the 4th respondent lodged a complaint before the 3rd respondent on 17.09.2016 agianst the petitioner alleging that on the intervening night, he found that the petitioner has broke open the lock and thrown out his household articles with the help of anti-social elements and basing on the said complaint, the 3rd respondent registered the above said crime. Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in FIR No.230 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 2nd November, 2016 KL
