HON'BLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER C.M.P. No.613 OF 2017 ORDER:

Heard Mrs. Y.I. Sivakalpana Reddy, learned counsel for the revision petitioner - wife. Though, respondent - husband entered appearance, no representation for him.

2. The ground on which the request to withdraw F.C.O.P. No.387 of 2017 from the file of Judge, Family Court - cum - Additional District Judge, Guntur and to transfer the same to the file of Judge - cum - VI Additional District Judge, Nellore, was based on the ground that the petitioner has been taking shelter at her parents' house having been necked out just 20 months after the marriage and even a child was born out of their wedlock who is 21⁄2 years old now, and it is difficult for her to travel all the way from Nellore to Guntur not only on account of the financial constraint, but also lack of male assistance to her to accompany to the Court with the child.

3. When kept in view, the said circumstances, certainly, there is reason to accede to the request.

4. Therefore, the Transfer Civil Miscellaneous Petition is allowed. F.C.O.P. No.387 of 2017 pending on the file of the Judge, Family Court - cum - Additional District Judge, Guntur, is withdrawn and transferred to the Judge, Family Court - cum - VI Additional

ASN,J Tr.CMP No.613/2017 District Judge, Nellore, for disposal in accordance with law. No order as to costs.

5. The learned Judge, Family Court, Nellore, shall issue notices to both parties on receipt of records from the Judge, Family Court, Guntur.

As a sequel thereto, miscellaneous petitions, if any, pending in the Transfer CMP, stand closed.
