THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 30995 of 2018 ORDER:

In this Writ Petition, grievance of the petitioner is that the respondent police, particularly, Deputy Superintendents of Police, are harassing by repeatedly calling him to the Police Station and forcing him to settle the disputes with his family members.

Ms. Vallabhaneni Shantisri, learned counsel, states that she is appearing on behalf of estranged wife and she opposes the Writ Petition.

A perusal of the material on record discloses that there are disputes between the petitioner and other family members with respect to various properties and such matters are pending before various Courts, including the Apex Court.

It may be noted that estranged wife is before this Court without even filing a caveat itself and opposing the relief which the petitioner is claiming in this Writ Petition. This creates a doubt in the mind of the Court that there is some element of involvement of the police in the matter.

CKR, J WP.No.30995 of 2018 In view of the above, considering the age of the petitioner and having regard to the nature of relief sought by him, this Writ Petition is disposed of with the direction to the respondent police that if the presence of the petitioner is required with respect to any of the crimes alleged to have been registered against him, he shall not be called to the Police Station without giving him any notice and that if any undue incident happens on account of the age of the petitioner, the respective Police Officers are responsible and are liable to be prosecuted. It is clarified that there is no stay granted by this Court in the case on hand with respect to the police conducting investigation into the crimes said to have been registered against the petitioner in accordance with law.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
