THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12838 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.7 in Crime.No.309 of 2023 on the file of Mangalhatt Police Station, Hyderabad, registered for the offences under Sections 8 (c) r/w. 20(b (ii) (B) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the Mangalhat Police is that on 09.10.2023 on receiving information, they have conducted raid in a house wherein this petitioner along with others found in possession of 2 kgs. of ganja and cash of Rs.3,07,500/-. The Police apprehended this petitioner and remanded to judicial custody. 4.

Learned counsel appearing for the petitioner would submit that no offence is committed by this petitioner and nothing has been seized from his possession. The implication of this petitioner

is on the basis of confession of other accused and sought for relief of bail.

Since the only basis for implication of this petitioner is confession, this Court is inclined to grant the relief of regular bail can be considered, subject to following conditions:- i) The petitioner/Accused No.7 shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with two sureties, for a like sum each to the satisfaction of the XVI Additional Chief Metropolitan Magistrate, at Hyderabad.

ii) The petitioner/Accused No.7 after release shall appear before the concerned Station House Officer on every Monday at 10:00 a.m. for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

iii) The petitioner/Accused No.7 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
