HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9174 of 2018 ORDER:

The petitioners are accused Nos.1 to 6 in S.C.No.9 of 2012 on the file of learned Special Sessions Judge for SC & ST Cases, Visakhapatnam.

The accused after completion of the prosecution evidence filed the petition in Crl.M.P.No.303 of 2018 covered by the impugned order dated 24.04.2018 to recall the IO by receiving the document, which is earlier referred report filed by the police in the crime to exhibit through IO and that was ended in dismissal and aggrieved by it, the present petition is filed.

The accused got a right to file any such referred report in his Section 313 Cr.P.C. examination as part of his defence. Having regard to the above, this Criminal Petition is disposed of and the trial Court is directed to receive said report under Section 313 Cr.P.C. examination and if at all Section 313 Cr.P.C. examination already completed to receive the document and place on record by virtue of this order as part of Section 313 Cr.P.C. examination.
