THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NOS.31937 AND 31967 OF 2016 COMMON ORDER The writ petitioner in both the writ petitions is common. His case is that the 3rd respondent in both the writ petitions filed applications in form 6-A under A.P. Rights in Land Pattadar Pass Books Act, 1971 and the Rules made thereunder for mutation. He filed objections on 16.7.2016 stating that the vendor of the 3rd respondent lost the suit in O.S.No.288/1995 on the file of Junior Civil Judge Medchal, Rangareddy District for specific performance in respect of the subject land in the writ petitions and hence the 3rd respondent cannot get any title and, therefore, the 2nd respondent - Deputy Collector and Tahsildar, is not justified in entertaining the application for mutation in file Nos.B/911/2016 and B/912/2016. Aggrieved by the action of the 2nd respondent in entertaining the application in Form 6-A for mutation of subject lands, the present writ petitions have been filed.

Heard the counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

Having regard to the facts and circumstances and the submissions of the learned counsel, without expressing any opinion on merits, the writ petitions are disposed of at the stage of admission directing the 2nd respondent to issue notices to the petitioner as well as the 3rd respondent and after considering the objections, shall pass appropriate orders in accordance with law. No order as to costs.
