Ayesha Tabassum (Previous Name Avula Nikitha), v. The Government Of Telangana
THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON No.35019 of 2014 ORDER:
There is no representation on behalf of the petitioners. 2.
The prayer sought in the writ petition is as under: 'It is therefore humbly prayed that this Hon'ble Court may be pleased to issue a writ, order or direction, more particularly a writ of Mandamus declaring the action of the Respondents for not providing the protection to the life and liberty of the Petitioners is illegal, ultra vires, null and void, and against the fundamental and constitutional rights of the petitioners in the interest of justice and equity or pass any other orders as deem fit in the circumstances of the case.'
3.
The learned Government Pleader placed on record the written instructions issued by the Inspector of Police, Bowenpally Police Station, Secunderabad.
4.
From the perusal of the said instructions, it is revealed that the first petitioner fell in love with one Zaffer Khan, who is residing in the same locality of the petitioner, and converted her into Islam on 05.11.2014 with her free will and consent and changed her name as Ayesha Tabassum. Subsequently, they married on 07.11.2014 in the presence of Khaji and living happily. Originally, the first petitioner was prosecuting her B.Tech Course at Mallareddy Engineering College and she was staying in the premises of hostel situated at Maisammaguda, Pet Basheerabad, Ranga Reddy District. After marriage with the second petitioner, she left the hostel on 07.121.2014. The fifth respondent, who is the father of the first petitioner, after noticing that the first petitioner is missing, lodged a complaint at Pet Basheerabad Police Station. Pursuant thereto, a case in Crime No.458 of 2014 under the heading 'woman missing' was registered on 08.11.2014. It is further mentioned in the written instructions that the
fifth respondent neither lodged a complaint in Bowenpally Police Station nor the third respondent registered a case. However, the Pet Basheerabad Police Station only registered the missing case and undertaken the investigation. Therefore, the third respondent is no way concerned to interfere in the peaceful life of the petitioners. Therefore, the allegations leveled by the first petitioner are false and baseless. A copy of the said FIR was also enclosed to the written instructions. 5.
In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed. 6.
Accordingly, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs. ____________________ JUSTI CE P.KESHAVA RAO Date:08.01.2020 PGS
