This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the action of the respondent No. 2 in non taking any action against the respondents/accused in FIR No.
79/2013 dated 17.04.2015 pending on the file of Town Police Station Jagtial, karinmagar District as arbitrary and illegal and also violative of procedure prescribed under Cr.P.C. consequently direct the respondents to take action against the respondents No.3 and 4 /accused or to pass." Heard Sri D. Radha Krishna, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.
Today, when the matter is called, written instructions, dated 28-08-2015 furnished by the Sub-Inspector of Police, Jagtial Town Police Station, Karimnagar District have been placed on record by the learned Government Pleader for Home and the said instructions read as under:
"It is respectfully submitted that the petitioners herein filed a private complaint U/S 200 Cr. P.0 on the file of the Hon'ble Court of Additional Judicial First Class Magistrate, Jagtial stating that he has two daughters namely Rani Jayachandra and Rani Jayanandana. The marriage of Rani Jayanandana was perfomed with the 4tH respondent-Swargam Sathish Chandra and after the marriage the husband and father-in-law of the said Rani Jananandana harassed her mentally and physically for additional dowry. Further the complainant mentioned that he given amount to the accused persons for purchasing the property.
It is respectfully that upon receipt of the above private
complaint, the Honourable Court forwarded it to this Respondent Police station for investigation and report U/S 156(3) Cr.P.C. On receipt of the private compliant from the Honourable Court, a case in Cr. No. 79/2015 dated: 17-042015 u/S 406 IPC & Sec 6 of Dowry Prohibition Act and sec 156(3) Cr.P.C., has been registered against the respondents 3 and 4 herein on t h e f i l e o f J a g t K a r i m n a g a r i s t r i c t a investigation has been taken up.
I t i s s u b m i t t e d t i n v e s t i g a t i o n t h e c o m p l a i n a n t a n d e x a m i n e d a n d r e c o r d e detailed statements.
It is submitted that the Notice U/S 41-A Cr.P.C., was served Al on 21-04-2015 and A-1 approached before the investigation agency and denied all the allegation, Further the complainant did not produce any documents in support of his claim. It is submitted that after receiving the relevant documents t property from the complainant, the investigation will be finalized.
On noticing the above said instructions, learned counsel appearing for the petitioner has requested this Court to record the said instructions and further direct the police authorities to expedite the investigation.
In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 28-08-2015 furnished by the Sub-Inspector of Police, Jagtial Town Police Station, Karimnagar District and the respondent police authorities are further directed to expedite the investigation in Crime No.79 of 2015.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
