R.V.Srinivasa Rao, v. Sri Ravinutala Prakasa Rao,
The Hon'ble Sri Justice C.V.Nagarjuna Reddy Civil Revision Petition No.2091 of 2015 Dated 19.06.2015 Between:
RV.Srinivasa Rao
...Petitioner
and Sri Ravinutala Prakasa Rao and 9 others
...Respondents
Counsel for the Petitioner: Party-in-Person Counsel for the respondents: None appeared The Court made the following:
Order:
This Civil Revision Petition arises out of Order, dated 21-04-2015, in IA.No.Nil of 2012 in OS.No.198 of 1983, on the file of the Court of the learned I Additional Senior Civil Judge, Guntur.
I have heard the petitioner, who appeared as party-in-person.
On a careful consideration of the entire material on record, I am of the opinion that the view
taken by the lower Court in the order under revision is supported by sound reasons and I am entirely in agreement with the conclusion drawn by the lower Court that having regard to the fact that the proceedings in OS.No198 of 1983 have attained finality and no part of the judgment or order passed therein was reversed by the heirarchial Courts, an application under Section 144 r/w 151 of the Code of Civil Procedure, 1908, is not maintainable.
Therefore, the Civil Revision Petition is dismissed.
As a sequel to dismissal of the Civil Revision Petition, CRPMP.No.2784 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous.
