HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9352 of 2016 ORDER:

This petition is filed by the petitioner/accused under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail in Crime No.831 of 2015 on the file of Afzalgunj Police Station, Hyderabad, registered for the offences punishable under Sections 498 & 302 IPC. Heard and perused the material available on record. The allegation against the petitioner is that the petitioner has come down to Hyderabad from his native place for livelihood, and suspecting that the deceased wife is having illicit contacts with another person has killed her by burning her.

Learned counsel for the petitioner submitted that the petitioner was arrested and remanded to the judicial custody and from the month of January, 2016, he has been in judicial custody. Learned Additional Public Prosecutor submitted that the petitioner is native of Sofipur Village, Chandwargate Post, Basai Mohjammedpur (Thana) Firozabad District of Uttar Pradesh State and he does not have any roots here and the release of the petitioner would certainly cause prejudice to the trial before the trial Court. Considering the facts and circumstances of the case and the submissions of the learned Additional Public Prosecutor, I am not inclined to grant bail to the petitioner.

Hence, the Criminal Petition is dismissed.
