HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31062 OF 2018 ORDER :
The case of the petitioner is that he is the owner and possessor of land to an extent of Ac.0.43 cents in Survey no.891 of Machapuram Village, Devanakonda Mandal, Kurnool District; and that when the unofficial respondents tried to disturb the possession of the petitioner, he filed OS.No.218/2017 and the same was decreed by the Court below on 09.05.2018 by granting perpetual injunction in favour of petitioner. Inspite of the injunction order in favour of the petitioner, the respondent police are interfering with the possession of the petitioner over the subject land at the instance of unofficial respondents. Aggrieved by the same present writ petition is filed.
The aforesaid allegations are denied in the written instructions submitted by the learned Assistant Government Pleader for Home.
Having regard to the aforesaid facts and circumstances, keeping in view the injunction granted by the Court below in favour of petitioner in OS.No.218/2017, dated 09.05.2015, the writ petition is disposed of directing the respondent police not to interfere with the possession of the petitioner. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
