THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.2798 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.324 of 2015 on the file of the Additional Judicial Magistrate of First Class, Kovur. Heard the learned counsel appearing for the petitioner/accused and the learned Additional Public Prosecutor representing the State. Learned counsel for the petitioner/accused submits that the petitioner is aged about 81 years and it will be difficult for him to attend for each and every adjournment and prays to dispense with his presence.

Having perused the material on record, it is not a fit case to quash the proceedings. However, on the submissions of the learned counsel for the petitioner, this Court feels that appropriate directions may be given to dispose of the main C.C. itself as expeditiously as possible.

In that view of the matter, the Criminal Petition is disposed of directing the Additional Judicial Magistrate of First Class, Kovur, to dispose of C.C.No.324 of 2015 within a period of three (3) months from today, without insisting for the presence of petitioner/accused on each and every adjournment, unless the Court feels that his presence is necessary for any specific purpose.

Pending miscellaneous applications, if any, shall stand closed in consequence.
