Order :

The grievance of the petitioners in this Writ Petition is that though respondent No.5, who was elected as member of the Mandal Praja Parishad Terrorial constituency, had three children at the time of her election, respondent Nos.3 and 4 have not taken any action for her disqualification under Section 19(3) of the Andhra Pradesh Panchayat Raj Act, 1994, by following the procedure prescribed under Section 22

(1) thereof.

The petitioners pleaded that they have submitted a representation on 23-09-2015 to respondent No.4 for initiating action under the above-mentioned provisions and that no action has been taken so far.

After hearing Mr.G.Narender Reddy, learned Standing Counsel for Zilla/Mandal Praja Parishad representing respondent Nos.3 and 4, I am of the opinion that the interests of justice would be met, if respondent No.4 is directed to consider the petitioners' representation and based on the prima facie material that may be produced by them, initiate appropriate action under the above-mentioned provisions within four weeks from the date of receipt of this order. If, for any reason, respondent No.4 rejects the request of the petitioners, he shall pass a reasoned order and communicate the same to the petitioners within the above stipulated time. Subject to the above directions, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.46626

of 2015, filed by the petitioners for interim relief, is disposed of as infructuous.
