THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.16486 of 2011 ORDER:

This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, to declare the action of the respondent in issuing notice, dated 30-04-2011 under Sections 428 and 433 of Hyderabad Municipal Corporation Act to the petitioner and further interfering with the property admeasuring 186.5 Sq.yards bearing H.No.3-5-622 situated at Vittalwadi, Narayanaguda, Hyderabad as illegal and arbitrary.

Heard and perused the material available on record. Earlier, this Court passed an interim order, dated 15-06-2011 in W.P.M.P.No.19782 of 2011 in W.P.No.16486 of 2011 as follows:

"Pending further orders, the respondents are directed not to interfere with the construction of the building provided the same is in conformity with the sanctioned plan."

Considering the earlier interim order, if there is any deviation in the construction made by the petitioner herein, contrary to the sanctioned plan, the respondent shall take action, by following due process of law, after issuing notice to the petitioner.

Accordingly, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
