THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14534 of 2024 ORDER:

This criminal petition is filed seeking for relaxation of the condition imposed in paragraph No.8 of the order dated 05.09.2024 passed by the I Additional Junior Civil Judgecum-VII Additional Judicial Magistrate of First Class, Hayathnagar (for short 'trial Court'), in Crl.M.P.No.649 of 2024 in Crime No.946 of 2024.

Heard Sri. S.Rama Mohan Rao, learned counsel for petitioners and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for the State and perused the record.

By the aforesaid order, while granting bail, the petitioners/accused Nos.2 and 3 was directed to appear before the Station House Officer, Vanasthalipuram, on every Monday between 10:00 AM and 04:00 PM, until charge sheet is filed. 4.

It is submitted by the learned counsel for petitioners/accused Nos.2 and 3 that though nearly 3 months have been lapsed, charge sheet is not yet filed. The petitioners/accused Nos.2 and 3 have been complying with

SKS,J Crl.P.No.14534 of 2024 the said condition imposed by the trial Court from the date of the order and there is no allegation of his violating the same, and hence, sought for relaxation of the said condition. 5.

The learned Additional Public Prosecutor does not dispute the submission made by the learned counsel for petitioner.

Since the petitioners/accused Nos.2 and 3 have been complying with the condition imposed by the trial Court without any violation, this Court is of the considered view that it is a fit case to relax the said condition. 7.

Accordingly, this petition is allowed and condition imposed in paragraph No.8 of the order dated 05.09.2024 passed by the trial Court, in Crl.M.P.No.649 of 2024 in Crime No.946 of 2024, is hereby relaxed and the petitioners/accused Nos.2 and 3 shall make themselves available for interrogation as and when required by the Police, till filing of charge sheet. Miscellaneous applications, if any pending, shall stand closed.
