THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.13931 of 2025 ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners-accused Nos.1 to 4, in Crime No.622 of 2025 before the Ameenpur Police Station, Sangareddy District, registered for the offence punishable under Section318(4), 338, 336(3) and 340(2) of the Bharatiya Nyaya Sanhita (BNS).

The brief facts of the case are that on 16.10.2025, the defacto complainant lodged a report with the police stating that the petitioners had obtained building permission for the construction of a stilt plus five upper floors residential building, vide Permit No.0098/BP/3121/2022. The complainant further mentioned that the petitioners had submitted Layout Regularization Scheme (LRS) proceedings bearing No.9622/LRS/ZO-SKP/HMDA/2014 dated 12.12.2020, purportedly issued by the Hyderabad Metropolitan Development Authority (HMDA). Upon verification, the Estate Officer of HMDA informed that the said LRS proceedings were not issued by HMDA and that the amount of

Rs,10,49,978/- had not been credited to the accounts of HMDA. Consequently, the officer requested the police to take necessary action. Based on the said complaint, a case was registered under Crime No.622 of 2025 for the aforementioned offence. 3.

Heard Sri G. Anil Kiran Kumar, learned counsel for the petitioners-accused Nos.1 to 4, and Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State. 4.

The contention of the learned counsel for the petitioners is that the petitioners are innocent of the allegations and have been falsely implicated in the crime and that the petitioners have not committed any forgery and that they purchased the property under an approved layout. The document alleged to be forged is not required for an approved layout, and therefore, the question of LRS does not arise. The petitioners obtained permission from HMDA by submitting all relevant documents. He further submitted that the case was registered only to harass the petitioners and emphasized that they are willing to cooperate with the investigation. Therefore, requested the Court to grant prearrest bail by allowing the criminal petition. 5.

On the other hand, learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for

petitioners stating that the petitioners obtained permission without submitting any valid documents and that the document submitted by them, purportedly based on LRS proceedings, is forged. He further stated that no LRS application was filed before HMDA and no amount was credited to HMDA's accounts. He further contended that granting anticipatory bail at this stage would obstruct the investigation and urged the Court to dismiss the criminal petition.

Upon considering the submissions made by both the learned counsel and examining the material available on record, it is noted that the de-facto complainant, while filing the complaint, submitted documents referring to an LRS application, whereas the petitioners claimed the property falls under an approved layout. Considering the facts and circumstances of the case, and noting that the investigation is primarily based on documentary evidence, this Court deems it appropriate to grant pre-arrest bail to the petitioners-Accused Nos.1 to 4 subject to the following conditions:

i.

The petitioners-accused Nos.1 to 4 shall surrender before the Station House Officer, Ameenpur Police Station, Sangareddy District, within two weeks from today, and

on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioners-accused Nos.1 to 4 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners-accused Nos.1 to 4 shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
