HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.31013 OF 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents 3 and 4 in not receiving the document ie., sale deed, dated 16.08.2018 for registration, which was executed by the petitioner in favour of Sai Siri Townships and Estates, to sell the property admeasuring Ac.2.00 in Sy.No.375/ E as per pahani 375/ AA3, situated at Muthangi Village and Gram Panchayat, Patancheru Mandal, Sangareddy District, as illegal and arbitrary. 2) The grievance of the petitioner is that the petitioner firm is the absolute owner and possessor of agricultural dry land admeasuring Ac.2.00 in Sy.No.375/ E situated at Muthangi Village and Gram Panchayat, Patancheru Mandal, Sangareddy District, which was purchased through registered sale deed bearing document NO.16112 of 2018 dated 30.04.2018 from one Abdul Aziz Baig through his GPA holders Mohammad Khalid Murtaza, Mohammad Jaffar, Mirza Mansoor Baig.

While things stood thus, due to personal necessities, the petitioner intends to sell the subject land and thereby approached the respondents 3 and 4 and presented the sale deed on 16.8.2018 for registration, who refused to receive the same, without assigning any reasons. Challenging the same the present writ petition came to be filed.

3) Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondents 3 and 4, to receive the document for registration, if the same is in accordance with the law. If they are not intending to register the documents presented by the petitioner, they shall return the same assigning the reasons, as early as possible, preferably, within a period of four weeks from today, after giving an opportunity of hearing to the petitioner and all the concerned. 4) With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to disposal of the writ petition, miscellaneous petitions, if any, pending shall stand closed.
