2. Heard Mr. G.Narendra Chetty, learned counsel for the petitioner. Mr. S.Suri Babu, learned Special Standing Counsel, takes notice for the respondents.
3. Admittedly, the assessment order has been set aside by the Appellate Authority on a regular appeal. Therefore, the order of penalty should also go. Hence, the writ petition is allowed and the impugned order is set aside. It is needless to say that if there is a fresh order of assessment, the respondents may be entitled to exercise their power. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
