THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 30968 of 2018 ORDER:

It is the case of the petitioner that in connection with the purchase of certain jewellery, she approached respondent No.6, who is the proprietrix of respondent No.5 firm and that when she demanded respondent No.7 for payment of money with respect to the chit subscriptions, respondents 6 and 7 are harassing her with the help of respondents 3 and 4. It is her specific case that respondents 3 and 4 are harassing her by visiting her house and damaging her reputation by informing the residents of the gated community, in which the petitioner is residing, that she involved in certain criminal activities. Her grievance is that without there being any complaint lodged/registered against her, respondents 3 and 4 are repeatedly calling her to Kachiguda Police Station. In the circumstances, she filed the present Writ Petition.

CKR, J WP.No.30968 of 2018 down by the Supreme Court in Arnesh Kumar v. State of Bihar1, if the presence of the petitioner is required in connection with any case/complaint.

On the other hand, learned Government Pleader for Home, on instructions, submits that on a complaint forwarded by the Office of the Director General of Police on 29.08.2018, respondent No.3 registered Crime No.217 of 2018 against the petitioner for the offences punishable under Sections 420 and 506 IPC and in the process of investigation, enquiries were made by the police officers and that the respondent police denied the allegation that the petitioner is being harassed in any manner. Having regard to the aforesaid submissions and inasmuch as a crime has already been registered against the petitioner, this Court deems it appropriate to direct that the respondent police shall investigate the matter by duly following the procedure prescribed by the Code of Criminal Procedure and shall not cause any undue harassment to the petitioner.

CKR, J WP.No.30968 of 2018 Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
