THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.5562 of 2013 ORDER:

The father of petitioner was an employee of the District Cooperative Central Bank Limited, Vizianagaram. He was working as a Special Category Assistant in Salur Branch and he died on 18.05.2011. He was the only bread earner in the family. The mother of petitioner also died in the year 2008 itself. In view of the said circumstances, the petitioner submitted a representation on 04.06.2011 to the respondents for appointment on compassionate grounds. The petitioner states that he is qualified with 10th class and Diploma in Electronics and Communications and he belongs to Schedule Caste community. In the circumstances, he sought appointment in suitable post. He also states that in some other cases, compassionate appointments were made. The petitioner submitted a representation on 01.12.2012 to consider his case. Respondent No.2 directed the Branch Manager of Salur branch to take the services of petitioner on daily wage basis as messenger and accordingly, he joined in Salur Branch, but no regular appointment order was issued. In the circumstances, he filed the present writ petition.

Though notice was ordered in this writ petition on 25.02.2013, no counter affidavit is filed for the last three years. In the above circumstances, this Writ Petition is disposed of directing the respondents to consider the case of petitioner for compassionate appointment in accordance with the Rules of the Bank and pass appropriate orders therein within three (3) months from the date of receipt of a copy of this order. No order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
