THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.5991 OF 2010 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.

2. The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not granting interest on the amount of compensation pursuant to acquisition of land of the petitioner as arbitrary and illegal, and consequently, to direct the respondents to consider and dispose of the representations, dated 07.07.2009 and 12.11.2009 made by the petitioner forthwith by granting interest @9% per annum on the compensation awarded.

3. Learned counsel for the petitioner mainly submits that the petitioner gave consent for acquisition of lands in Sy.Nos.424, 425, 427 and 428 admeasuring Ac.11-201⁄2 guntas situated at Narsingapur Village, Jagtial Mandal, Karimnagar District. It is his case that though possession was taken in the year 2008, compensation amount as agreed upon was paid a year after taking possession. Hence, it is urged that the petitioner is entitled for interest on the compensation amount for a period of one year.

4. Learned Government Pleader for Revenue opposed the relief claimed by the petitioner.

5. Without going into the merits of the case, the present writ petition is disposed of directing the respondents to consider the representations made by the petitioner to the appropriate authority

for grant of interest on the compensation and to dispose of the same in accordance with law, if they are pending, at the earliest, preferably within a period of six (06) months from the date of receipt of a copy of this order.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
