THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.43137 of 2015 ORDER:

The prayer of the petitioner in this case is as under: "For all the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ of Mandamus or any other appropriate writ, order or direction declaring the action of the respondents, especially 3rd respondent, in interfering with the personal liberty of the petitioner by sending his subordinates to residence of the petitioner and summoning her to the Police Station without there being any cause or case or reason as illegal, arbitrary and unjust and consequently, direct the 3rd respondent not to summon the petitioner to the 3rd respondent police station without there being any complaint or case against her and also without following the procedure contemplated under law and to pass such other order or orders as the Honourable Court deems fit and proper in the interest of justice."

The Station House Officer, Karapa Police Station, East Godavari District, filed a counter-affidavit, wherein he stated as under: "It is respectfully submitted that the allegation of the petitioner that the 3rd respondent calling the petitioner to the police station is incorrect, baseless, far from truth and has been created for the purpose of filing the present writ petition. It is submitted that this respondent never called the petitioner to the police station as alleged by her. It is respectfully submitted that when there is no criminal case is registered against the petitioner herein on the file of this respondent police station, the question of calling the petitioner does not arises.

It is respectfully submitted that all the other allegations leveled against the respondent police are false, hence denied."

The afore-stated stand of the police authorities is taken on record. In the light thereof, no adjudication is warranted on merits. Ms. K. Sumathi, learned counsel representing Mr. G.L.

Nageswara Rao, learned counsel for the petitioner, is also agreeable to the disposal of the case recording the afore-stated stand of the police authorities.
