THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.22830 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the 4th respondent and his subordinates in interfering with the operations of the peeling machine of the petitioner Saw Mill without any authority of law as being arbitrary, illegal, 'without jurisdiction, discriminatory, and in violation of the provisions of Rule 9 of A.P. Saw Mills (Regulations) Rules, 1969 and contrary to the orders passed by this Court in W.P.No.23920 of 2012 dated 03-08-2012 and other related cases and the instructions issued by the 2nd respondent in Ref.No.20678/2004X2 dated 30.9.

2004 and consequently hold that the petitioner is entitled to have the same benefits as extended to the similarly placed units by according permission if necessary for the peeling machine in accordance with the provisions of the A.P. Saw Mills (Regulations) Rules, 1969 with a further direction to the respondents restraining them from interfering with the lawful operations of the petitioner saw mill including that of the peeling machine and to pass such other orders. The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the writ petition. Permission is granted.

Hence, the Writ Petition is dismissed as withdrawn. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
