This Criminal Petition is filed under Section 438 of Cr.P.C to enlarge the petitioner/accused on bail in the event of his arrest in connection with Crime No.1182 of 2016 of Banjara Hills Police Station, Hyderabad, registered for the offences punishable under Sections 420, 406, 468, 471 and 506 IPC apprehending his arrest.

After arguing the matter for a while, learned counsel for the petitioner requested the Court to permit the petitioner to surrender before the III Chief Metropolitan Magistrate, Nampally, Hyderabad, and file an application under Sections 437 and 439 Cr.P.C. for grant of bail and on such surrender, the learned Magistrate may be directed to decide the application on the same day.

Acceding to the request of learned counsel for the petitioner, without touching the merits of the case, I deem it appropriate to permit the petitioner to surrender before the III Chief Metropolitan Magistrate, Nampally, Hyderabad and on such surrender, the learned Magistrate is requested to decide the application for bail, if any, filed under Sections 437 and 439 Cr.P.C., after serving notice on the learned Public Prosecutor, on the same day.
