THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.8760 of 2009 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the order dated 06.01.2009 passed in M.C.No.159 of 2007 on the file of the Court of IV Additional Junior Civil Judge, Guntur. On 31.10.2014 this Court directed the learned counsel for the petitioner to take out personal notice to the private respondent i.e., respondent No.1 by RPAD and file proof of service in the Registry. Since 2009 the learned counsel for the petitioner has not taken any steps to serve notice on respondent No.1. On 03.03.2016, the learned counsel for the petitioner requested one week time to ascertain whether the cause in the criminal petition survives or not. At the time of arguments, the learned counsel for the petitioner submitted that he could not contact the petitioner. The material available on record reveals that the petitioner is not interested to prosecute the matter. Hence, no purpose will be served by keeping the matter pending.

Accordingly, the Criminal Petition is dismissed. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
