HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7683 of 2016 ORDER:

This petition is filed by the petitioners/A-1 & A-2 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail in Crime No.10 of 2016, on the file of Maredumilli Police Station, East Godavari District, registered for the offences punishable under Section 8(c) read with 20(b)(ii) of the NDPS Act.

Heard and perused the material available on record. The allegation against the petitioners is that they were found in possession of 94 kgs., of ganja.

Learned counsel for the petitioners submitted that the petitioners were arrested on 03.02.2016 and that they are innocent of the offence alleged against them.

Learned Public Prosecutor submitted that when the police were conducting vehicle checking, on seeing the police, the petitioners tried to abscond, but the police detained them and interrogated them, upon which they informed that they are in possession of 94 kgs of ganja in the auto.

Considering the above facts and circumstances of the case and the submissions of the learned Public Prosecutor and since the ganja seized is commercial quantity, this Court is not inclined to grant bail to the petitioners at this stage.

Hence, the Criminal Petition is dismissed.
