This petition is filed under Section 482 of Cr.P.C. seeking to quash the proceedings against the petitioner in M.C.No.7 of 2009 on the file of Judicial First Class Magistrate, Prathipadu, East Godavari District. The learned counsel for the petitioner represented that the 2nd respondent herein who is the petitioner in the maintenance case, has withdrawn the maintenance case, hence the cause in the present criminal petition does not survive for adjudication.
