2018-08-30P Naveen Rao2 pages

THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.30996 of 2018 ORDER :

The petitioner is aggrieved by the order of suspension from service dated 28.10.2017. Simultaneously, he was also called upon to submit explanation on the charges levelled against him. According to the learned counsel for the petitioner, though explanation was submitted by the petitioner, there was no progress in the enquiry and, on the contrary, he is continued under suspension for no fault of him.

Regard to the charges levelled against the petitioner, this Court is not inclined to grant any relief at this sage. However, as the suspension was made on 28.10.2017 i.e more than 10 months ago, this Court deems it fit to direct the respondents to complete the disciplinary enquiry and to pass orders by following due procedure, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. For any reason, not attributable to the petitioner, disciplinary proceedings are not concluded, the respondents are directed to reinstate him into service.

The Writ Petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed.
