THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Writ Appeal No.532 of 2008 JUDGMENT: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred against the order passed in W.V.M.P.Nos.617 and 823 of 2008 in W.P.M.P.No.29890 of 2007 in W.P.No.22942 of 2007 dated 16.04.2008.
The appellant herein is the petitioner in the writ petition. They invoked the jurisdiction of this Court questioning the action of the A.P. State Financial Corporation in directing them to hand over Ac.1.00 of land on the ground that the land in their possession was more than the land sold to them in auction. While an interim order was initially granted, the said order was vacated by the learned Single Judge holding that, prima facie, an extent of Ac.1.00 of land, for which the eviction notice was given, was not covered by the property sold to the petitioner. Aggrieved thereby, the present appeal has been preferred. By its order, in W.A.M.P.No.1125 of 2008 dated 21.05.2008, the Division Bench suspended the order of the learned Single Judge, directing that the appellant shall not alienate or otherwise encumber the disputed property.
As the interests of the respondents herein have been safeguarded by the order of the Division Bench, and as the said interim order has been in force for the past eight years, we do not see any reason to vacate the said order, at this point in time. It would be appropriate, instead, that the writ petition itself be finally heard at the earliest. The interim order passed by this Court in
W.A.M.P.No.1125 of 2008 dated 21.05.2008 shall continue to remain in force till the disposal of the writ petition. The Writ Appeal is, accordingly, disposed of. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
