HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Civil Revision Petition No.5025 of 2018 ORDER :

Heard both sides. Practically there is nothing to interfere with the impugned order of the lower Court and the law is fairly settled from the expression of this Court in Crl.R.C.No.2346 of 2016 dt.20.01.2017 in Naveen Krishna Bothi Reddy Vs. State of Telangana1 referring to several expressions of the Apex Court including the right of privacy, personal liberty and right to live. At this stage, the learned counsel for the petitioner drawn attention of the Court of memo in USR No.67098 of 2018,dt.01.09.2018 saying other than at Government Hospital, Nellore, he may be directed to undergo examination in any hospital in Hyderabad. The learned counsel for the respondent/ petitioner before the lower Court in I.A.No.779 of 2018, dt.07.08.2018 stated no objection.

Having regard to the above, impugned order of the lower Court in directing to undergo the examination before the Government Medical College, Nellore, is modified to undergo said examination by a Committee of Doctors at Nizams Institute of Medical Sciences( for short, 'NIMS'), Hyderabad to be constituted by the Director of NIMS, by virtue of this order. Further the Director, NIMS Hospital, by virtue of this order, to constitute a committee and intimate to parties.
