HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13051 OF 2017 ORDER:
This writ petition is filed against the proceedings No.B/2259/2015, dated 28.09.2016 issued by the 2nd respondent.
Learned counsel for the petitioner submits that when the 4th respondent filed an application seeking clarification as to how the subject land was transferred in the name of third parties, the impugned order is passed giving findings against the petitioner. He also submits that the Tahasildar has no power to entertain any application for correction of entries beyond one year. In support of this contention he relied on the Judgment of this Court in G.Prabhakar v. State of Telangana and others (2015 (4) ALD 427). He also submits that the 4th respondent has already filed appeal against the impugned order.
On the other hand learned Assistant Government Pleader for Revenue submits that since the 4th respondent has already filed appeal, petitioner can agitate his rights in the said appeal. A perusal of the impugned proceedings goes to show that no relief is granted to the 4th respondent. It is not known why the petitioner is aggrieved by the impugned order, though there is no relief in favour of 4th respondent. However, petitioner has alternate remedy of appeal against the same. Moreso, appeal
filed by the 4th respondent against the impugned order is pending and petitioner can file objections in the said appeal. Had any relief is granted to 4th respondent that would have been a different matter. Since no relief is granted against the 4th respondent, this Court is not inclined to entertain the writ petition.
Accordingly, the writ petition is dismissed granting liberty to the petitioner to avail alternate remedy as per law. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 12.04.2017 t k.
