HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 31027 OF 2018 ORDER:
1) Heard learned counsel for the petitioners and learned Government Pleader for Revenue. With the consent of both the parties, the main writ petition is being taken up for disposal at the admission stage itself.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No. 2 in not disposing of the representation of the petitioners dated 23-07-2018, seeking re-assignment of land admeasuring Ac. 5.41 cents in survey Nos. 691, 693, 694, 695/ 1 and 696/ 2 situated at Bilakalagudur Village, Gadivemula Mandal, Kurnool District, as illegal, arbitrary and unconstitutional and consequently direct the respondents to re-assign the land under Section 4 (1) (b) of A.P. Assigned Lands (Prohibition of Transfers) Act, 1977. 3) Learned Government Pleader for Revenue submits that if the said application is still pending consideration before respondent No. 2, the respondent No. 2 may be directed to consider the said representation in accordance with law.
4) Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of directing the second respondent to deal with the representation of the petitioners dated 23-07-2018,
seeking re-assignment of land referred to above, in accordance with law, as expeditiously as possible. No order as to costs. 5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
