THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.31109 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner is a rice mill and has been in the business of milling paddy under a valid license, which is valid upto 31.03.2018. While so, on 22.04.2014, the third respondent along with Vigilance and Enforcement Officials, inspected the rice mill and found some variation in the stock and 6-A proceedings were initiated against the Managing Partner of the mill. A show cause notice was issued to the petitioner on 18.05.2014, and pending disposal of the 6-A case, an order was passed by the second respondent on 10.11.2014 for interim disposal of the seized stock. Challenging the same, the present Writ Petition is filed.

When the Writ Petition came up for consideration on 23.09.2015, it was adjourned to get the instructions with regard to the action taken pursuant to the impugned order passed by the second respondent. Though the Joint Collector, Kurnool, issued a communication in the month of September, 2015 to the learned Government Pleader, there is no information with regard to disposal of the seized stock pursuant to the impugned order. Since the proceedings before the second respondent are pending for more than a year, this Court feels it proper to dispose of the Writ Petition with a direction to the second respondent to conduct an enquiry and finalize 6-A proceedings pending before him, within a period of 60 days from the date of receipt of a copy of this order, by giving due opportunity to the petitioner.

4. The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any pending, shall stand closed.
