HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.31496 of 2014 ORDER:

Petitioner asserts that he is the founder family member of Sri Panduranga Vittaleswara Venkatadri Swamy Temple. It is the case of the petitioner that by proceedings dated 06.10.2012, he was appointed as non-hereditary trustee to the said temple for a period of two years, pursuant to which he had taken oath on 10.10.2012. During his tenure as trustee, petitioner had protected the interests of the institution by initiating legal proceedings, particularly, recovery of arrears from the tenants. It is the contention of the petitioner that as on the date of filing of the Writ Petition, successors-in-interest were not appointed and if there is vacuum the interests of the institution would suffer. In those circumstances, the petitioner seeks Writ of Mandamus for a direction to allow him to continue till such time as regular Trust Board is constituted.

A counter-affidavit is filed by respondent No.4 along with vacate petition.

Learned Government Pleader for Endowments appearing for the respondents would submit that notification dated 31.08.2016 was issued calling for applications for appointment of trustees and to constitute Trust Board pursuant to which about 50 applications have already been received and the authorities are in the process of scrutinizing the same and verifying the antecedents of the candidates who had applied and the same would take some time.

CKR, J W.P.No.31496 of 2014 Having considered the limited relief which is being claimed by the petitioner and considering the fact that notification has already been issued for constituting Trust Board, there shall be direction to the respondents-authorities to complete the process within a period of two months from the date of receipt of this order and till such time as the constitution of new Trust Board, petitioner may be permitted to render his services in accordance with law.

Writ Petition is accordingly disposed of. No order as to costs. As a sequel to disposal of the Writ Petition, miscellaneous petitions, if any pending in the Writ Petition, shall stand closed. __________________________ CHALLA KODANDA RAM, J January 4 2017 MRR
