HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.1433 OF 2017 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. to enlarge the petitioner on bail in Crime No.170 of 2016 of III Town Police Station, Ananthapuramu District, registered for the alleged offences punishable under Sections 498-A read with 34 I.P.C. and Section 67 of I.T. Act, 2000 and Sections 3 and 4 of the Dowry Prohibition Act, apprehending their arrest in the above crime.

After arguing the matter for some time, learned counsel for the petitioners requested this court to permit the petitioners to surrender before the Judicial Magistrate of First Class, Ananthapuram and to file an application for grant of bail after servicing notice to the Public Prosecutor and the learned Magistrate may be directed to decide the application on the same day in accordance with law.

In those circumstances, petitioner is permitted to surrender before the learned Judicial Magistrate of First Class, Ananthapuram, and on such surrender, the petitioners can file an application for grant of bail after serving notice to the Public Prosecutor before the said court and in the event of filing such an application, the said court is directed to decide the application on the same day itself in accordance with law. Accordingly, this Criminal Petition is disposed of.
