Nawab Mir Osman Ali Khan S/O Late Nawab Zulfekhar Jah v. The State Of Telangana, Rep. By Its Principal
THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 42082 of 2016 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue.
2.
With the consent of both the parties, the Writ Petition is disposed of at the admission stage.
3.
The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in not passing an order on the application dated 12.02.2009 filed under Section 4 of A.P.Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act'), as illegal and arbitrary.
4.
It is to be noted that an application seeking rectification of entries was made by the petitioners to the Tahsildar about two to three years prior to the date of filing of the writ petition. But, the appropriate authority to make rectification of entries relating to period beyond one year is the Collector as per Rule 9 of the Act.
5.
Since the Tahsildar is not the appropriate authority to pass orders on the representation dated 12.02.2009 seeking rectification of entries made beyond one year, I am not inclined
to grant any relief to the petitioners. However, the petitioners are at liberty to avail the remedies available under law. 6.
Accordingly, the writ petition is disposed of.
Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. _______________________________ JUSTICE C.PRAVEEN KUMAR 05.12.2016, vhb
