Heard learned counsel for the petitioner and learned Government Pleader for Revenue for respondents 2.
Petitioner claims to be the owner and in possession of land to an extent of Ac.0-39 guntas in Sy.No.198 of Mahabubabad Village, having purchased the same by way of registered sale deed dated 16.11.1968. According to petitioner, he wanted to sell the land and when he tried to clean his land, neighbours intervened and objected disputing the boundaries. In view of the objection raised by the neighbours, petitioner submitted representation to conduct survey and to demarcate his land. Along with the writ petition paper book, several notices issued for conducting survey are filed, but so far survey is not conducted.

According to learned counsel for the petitioner, due to the objection raised by neighbours survey is not taken up, but when petitioner requested for conducting of survey of his land, merely because the neighbours are objecting, the authority cannot withhold conducting of survey.

Having regard to the fact that the respondents received the application for conducting of survey and issued several notices, so far survey is not conducted and finalized, the Tahsildar, Mahabubabad Mandal-5th respondent is directed to take steps to conduct survey of land of the petitioner, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of copy of this order, by following due procedure as
- 3 - required by law, provided so far no final decision is made and communicated to the petitioner.
