THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 17383 OF 2017 O R D E R:

The grievance of the petitioner is that the respondents are trying to demolish the sheds of the petitioner in survey Nos. 52/B and 53/AA situated at Dammaiguda Village, Medchal District, pursuant to notices dated 01-09-2016 issued under Sections 452 (1) and 461 (1) of the Hyderabad Municipal Corporation Act, 1955.

Heard learned counsel for the petitioner and Sri Chatla Madhu, learned standing counsel for GHMC.

The case of the petitioner is that he submitted his explanation on 03-09-2016 to notices dated 01-09-2016 and without passing any final orders, the respondents are trying to demolish the subject property. Learned counsel for the petitioner submits that the petitioner will submit further explanation in view of the subsequent developments.

In view of the same, the Writ Petition is disposed of directing the respondents to pass final orders after considering the petitioner's explanation dated 03-09-2016 and also any further explanation to be filed within a period of two weeks from today. Till passing final orders, there shall be stay of demolishing the sheds of the petitioner in survey Nos. 52/B and 53/AA situated at Dammaiguda Village, Medchal District, pursuant to notices dated 01-09-2016. If the petitioner fails to submit further explanation, the respondents shall pass appropriate orders basing on the explanation already submitted by the petitioner. Pending miscellaneous petitions, if any, in this Writ Petition shall stand closed in consequence. No order as to costs.
