This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner-A.2 seeking to quash the proceedings against him in Sessions Case No.577 of 2011 on the file of the Principal Assistant Sessions Judge, Rajahmundry, East Godavari District (for short, 'the Court below'), for the offences under Sections 341, 307, 324 and 506 r/w 34 I.P.C.

Heard the learned counsel for the petitioner-A.2 and the learned counsel for the 1st respondent-State, apart from perusing the material on record.

Learned counsel for the petitioner-A.2 made a request to recall the NBW issued against the petitioner-A.2 on 16.06.2011 in Sessions Case No.577 of 2011. It is for the petitioner-A.2 to appear in the above Sessions Case and file an application to recall the NBW issued against him. If evidence is already recorded in the above Sessions Case and the accused are acquitted, after appearance and recall of the NBW issued against the petitioner-A.2, he can submit the same before the Court below and seek appropriate remedy.
