Kasagani Yadagiri v. The State Of Telangana
THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4069 of 2017 ORDER:
The petitioner/A.1 seeks bail in C.C.No.1 of 2014 on the file of Principal Sessions Judge, Warangal.
2.
The record shows that initially the petitioner was granted bail, but, however, he absconded twice. The petitioner was absent on 09.01.2015 and also 03.03.2015. Thereafter, Non-bailable Warrant was issued against him. The police produced him after arrest on 10.07.2015 and he was remanded to judicial custody and later he was enlarged on bail on 20.11.2015. Thereafter also, as the petitioner did not attend the Court proceedings, again Non-bailable warrant was issued on 27.01.2016, which was pending till 22.08.2016, on which date notice to sureties was issued and subsequently, the petitioner/A.1 was produced by police on 13.12.2016 and he was remanded to judicial custody. 3.
In the light of these background facts, in the considered view of this Court, there is no justification for the petitioner to seek for bail. However, considering the request of learned counsel for the petitioner, while dismissing the bail application, the trial Court is directed to dispose of the case, in accordance with law, expeditiously, but not later than five (05) months from the date of receipt of a copy of this order. Miscellaneous petitions, if any, pending in this petition shall stand closed.
