HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.31086 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 5th respondent, in not disposing of the appeal filed by the petitioner, under Section 11 of the Andhra Pradesh Survey and Boundaries Act, 1923 (for short, "the Act"), questioning the endorsement dated 9.5.2018 of the 6th respondent, whereby declining to conduct survey and to fix boundaries for lands admeasuring Ac.0.78 cents and Ac.0.60 cents, situated at Sy.Nos.576/3 and 579/3B respectively of Chinthakayala Kothagudem, H/o. Raghavapuram Revenue Village in Chinthalapudi Mandal, West Godavari District, as illegal and arbitrary. Learned counsel for the petitioner submits that though the petitioner submitted an appeal on 11.06.2018, questioning the endorsement dated 9.5.
2018 of the 6th respondent, the 5th respondent, did not take any action so far for disposing of the same. Learned Government Pleader for Revenue, would submit that the writ petition may be disposed of directing the 5th respondent, to dispose of the appeal filed by the petitioner, if it is in accordance with law, by taking into consideration the circulars issued by Chief Commissioner of Land Administration, Gollapudi, Vijayawada, from time to time and also the provisions of the Act and the Rules.
Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 5th respondent-Assistant Director of Survey and Land Records, to dispose of the appeal filed by the petitioner under Section 11 of the Act, taking into consideration the circulars issued by Chief Commissioner of Land Administration, Gollapudi, Vijayawada, from time to time and also the provisions of the Act, as early as possible, preferably within a period of three to six months from today,
after giving the reasonable opportunity of hearing to the petitioner and all the concerned.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
